Welcome to RollApp. These Terms of Service govern your use of our photo and video backup service. By accessing or using RollApp, you agree to be bound by these terms. If you don't agree to these terms, please don't use our service.
1. Acceptance of Terms
By creating a RollApp account, you represent that you are at least 18 years old or have reached the age of majority in your jurisdiction. If you're using RollApp on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
We may modify these terms from time to time. We'll notify you of material changes via email or through the service. Your continued use of RollApp after such modifications constitutes acceptance of the updated terms.
2. Service Description
RollApp provides cloud-based backup and storage services for your photos and videos. Our service connects to various third-party platforms (Google Photos, iCloud, Dropbox, Snapchat, etc.) to automatically backup your media files.
We offer different subscription tiers with varying storage capacities and features. All plans include end-to-end encryption, original quality uploads, and cross-platform synchronization.
3. Your Account
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account or any other security breach.
Account Information
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. We reserve the right to suspend or terminate accounts that contain false or misleading information.
One Account Per Person
Each account is intended for individual use. You may not share your account credentials with others or allow others to access your account, except as explicitly permitted by your subscription plan.
4. Your Content
Ownership
You retain all ownership rights to the photos, videos, and other content you upload to RollApp. We do not claim ownership of your content. Your photos and videos are yours, and they always will be.
License to RollApp
By uploading content to RollApp, you grant us a limited, worldwide license to store, backup, and display your content solely for the purpose of providing the service to you. This license includes the right to:
- Store and backup your content on our servers
- Process your content for features like face recognition and AI search
- Display your content to you across all your connected devices
- Create thumbnails and previews for faster loading
This license ends when you delete your content or close your account, except for reasonable backup copies which will be deleted within 90 days.
Content Restrictions
You may not upload, store, or share content that:
- Violates any laws or regulations
- Infringes on intellectual property rights of others
- Contains malware, viruses, or harmful code
- Contains child sexual abuse material (CSAM)
- Promotes violence, hate speech, or harassment
We reserve the right to remove content that violates these restrictions and to terminate accounts of repeat offenders.
5. Subscription and Billing
Free Trial
New users receive a 30-day free trial with access to all features. You can cancel anytime during the trial without being charged. If you don't cancel before the trial ends, you'll be automatically charged for your selected plan.
Subscription Plans
RollApp offers monthly subscription plans with different storage tiers. Your subscription automatically renews each month until you cancel. You can upgrade or downgrade your plan at any time.
Payment
You agree to pay all fees associated with your subscription plan. We accept major credit cards and other payment methods as displayed in your account settings. By providing payment information, you authorize us to charge the applicable fees to your payment method.
Price Changes
We may change our subscription prices from time to time. We'll provide at least 30 days' notice before any price increase takes effect. If you don't agree to the new prices, you can cancel your subscription.
Refunds
We offer a 30-day money-back guarantee. If you're not satisfied with RollApp within the first 30 days of your paid subscription, contact us for a full refund. After 30 days, subscriptions are non-refundable, but you can cancel at any time to avoid future charges.
6. Cancellation and Termination
Cancellation by You
You can cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. You'll continue to have access to your account until the end of that period.
Account Deletion
If you delete your account, all your content will be permanently deleted from our servers within 90 days, except as required by law. This action cannot be undone. We recommend downloading your photos and videos before deleting your account.
Termination by RollApp
We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or if your account has been inactive for an extended period. We'll provide notice before termination when possible and allow you to retrieve your content, except in cases of serious violations or legal requirements.
7. Third-Party Services
RollApp integrates with third-party services like Google Photos, iCloud, Dropbox, and Snapchat. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of these third-party services.
When you connect a third-party account to RollApp, you authorize us to access and retrieve your photos and videos from that service on your behalf. You can disconnect third-party services at any time through your account settings.
8. Privacy and Security
Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these terms by reference.
We use end-to-end encryption to protect your photos and videos. However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your data, we cannot guarantee absolute security.
9. Intellectual Property
The RollApp service, including its software, features, design, and branding, is owned by RollApp and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our service or software.
"RollApp" and our logo are trademarks of RollApp. You may not use our trademarks without our prior written permission.
10. Disclaimers
RollApp is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that:
- The service will be uninterrupted, secure, or error-free
- The results obtained from using the service will be accurate or reliable
- Any errors in the service will be corrected
- Your content will never be lost or corrupted (though we implement robust backup systems)
You are solely responsible for maintaining backup copies of your content. While we provide a backup service, we strongly recommend keeping your own copies of important photos and videos.
11. Limitation of Liability
To the maximum extent permitted by law, RollApp and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of goodwill, arising out of or related to your use or inability to use the service.
In no event shall RollApp's total liability to you for all claims exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless RollApp and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from:
- Your use of the service
- Your violation of these terms
- Your violation of any rights of another party
- Content you upload or share through the service
13. Dispute Resolution
Informal Resolution
Before filing a formal claim, you agree to contact us at legal@rollapp.com and attempt to resolve the dispute informally. We'll do our best to work with you to resolve any issues.
Arbitration
Any dispute arising from these terms or your use of RollApp shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property infringement or violations of these terms.
The arbitration shall be conducted by a single arbitrator in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.
Class Action Waiver
You agree to resolve disputes with us on an individual basis and waive your right to participate in class actions, class arbitrations, or representative actions.
14. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms will be brought exclusively in the federal or state courts located in San Francisco, California.
15. General Provisions
Entire Agreement
These terms, together with our Privacy Policy, constitute the entire agreement between you and RollApp regarding the use of our service and supersede any prior agreements.
Severability
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms remain in full force and effect.
Waiver
Our failure to enforce any right or provision in these terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing.
Assignment
You may not assign or transfer these terms or your rights and obligations under these terms without our prior written consent. We may assign these terms without restriction.
Survival
The provisions of these terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
